Terms & Conditions

The monthly service charge for Newber is $5, billed on the first of each month or the subsequent business day. During the first calendar month of service, there is no monthly service charge. However, we do charge a one-time $5 activation fee when service is initiated. For Newber calls within the Continental U.S., AK, HI, Canada, and Puerto Rico, usage is billed at a rate of 2¢/min, in 6-second increments. By default, international outbound calls are disabled for Newber. To activate international calling, and for more information on international rates, please contact a Newber representative at newber@freedomvoice.com.

 

The monthly service charge and any call charges will be automatically deducted from the Customer’s credit card on file. It is the Customer’s responsibility to maintain sufficient balance on the credit card account to allow for the settlement of charges. Interruption of service will be experienced in the event that the credit card account balance does not allow for the settlement of charges. Accounts which have been placed on-hold as described may be charged a $20 fee to resume service.

 

It is specifically understood and agreed that the Customer shall be using this service solely for lawful and appropriate purposes and the Customer hereby agrees to indemnify and hold FreedomVOICE Systems harmless from any and all claims of any nature whatsoever arising out of or concerning the Customer’s use in any manner of the services provided herein. In the event that FreedomVOICE Systems is brought into any action arising from or concerning the Customer’s activities, the Customer agrees to indemnify and hold FreedomVOICE Systems free from all arbitration, court and attorney’s costs and fees.

 

FreedomVOICE Systems reserves the right to immediately discontinue, disconnect, limit, or revoke service without warning to any Customer who, at the sole discretion and determination of FreedomVOICE Systems, causes any type of activity or load which is incompatible with our network, causes quality of service issues, or otherwise impairs our ability to maintain our services and provide service to our Customers. FreedomVOICE Systems shall not be liable for any direct or indirect damages resulting from a decision to discontinue, disconnect, limit, or revoke service with or without warning.

 

This agreement shall be governed by the laws of the State of California and any disputes or controversy arising hereunder shall be arbitrated or adjudicated in San Diego County, State of California. The Customer hereby consents to personal jurisdiction for all claims of any nature concerning the Customer and FreedomVOICE Systems in San Diego, California and specifically consents to service of process being effectuated by certified mail at the Customer’s address. In the event that any action is brought to enforce or construe any term or condition of this agreement, or for the breach of this agreement, or concerning the indemnification clause contained herein, the prevailing party shall be entitled to recover, in addition to all other damages, reasonable attorney’s costs and fees.

 

Newber service, although reliable, is not guaranteed. Liability for the interruption of service and/or a lack of quality of service, including but not limited to errors and omissions relating to directory listing and CNAM, shall be limited to a maximum of two months of Newber service charges. We reserve the right to interrupt service for maintenance and systems upgrades at our discretion. It is specifically understood and agreed that the format of services provided and all programs associated with the services provided under this agreement are the proprietary materials and information of FreedomVOICE Systems and that the Customer shall not, without the prior written approval of FreedomVOICE Systems, copy, duplicate, communicate, or modify the format of services provided or the format of any programs associated with the services provided under this agreement.

 

It is specifically agreed that FreedomVOICE Systems may identify the Customer as a customer of FreedomVOICE Systems and include the Customer’s name and logo in any marketing material that identifies customers of FreedomVOICE Systems.

 

Service may be cancelled at any time upon 30 days written notice.
